I. Overview

earnway.art (hereinafter referred to as "the Platform") is an online service platform that provides URL shortening services and link tracking data analytics. In order to expand website usage and increase brand awareness of earnway, the Platform offers free URL shortening services to all internet users. At the same time, free tracking services are provided for short links used by members of earnway.shop’s central database to create daily promotional task links.

On this basis, the Platform has established official paid subscription plans to offer users more advanced shortlink tracking, higher quota capacities, elevated ad revenue share percentages, and bulk management services.

III. Legal Creation and Operational Requirements for Short Links

When using the Platform’s services to create short links, users must strictly comply with the following provisions:

3.1 Content Legality Requirements

1. Compliance and Consistency: The long URL and the landing page content must be legal and compliant and must be consistent with the theme of the distribution channel (e.g., SMS, public accounts, social channels, etc.).
2. Strictly Prohibited Content: The following types of prohibited content are strictly forbidden:
   Zero Tolerance Policy: Religious extremism, fraud, phishing, pornography, gambling, narcotics and drugs, intimidation, smuggling, trafficking in personal information, malware distribution, and any other illegal or noncompliant content.
3. Domain Continuity: The domain name of the long URL used for conversion must remain continuously valid and accessible.

3.2 Short Link Operational Specifications

1. Security Review: Short links must pass the Platform’s automated and manual security review before they can be used. Nonfixed URLs that change dynamically or pass unknown parameters via variables in real time are restricted.
2. Single Compliant Redirection: Short links support only one clear and compliant redirection at most; malicious redirections, open redirects, or multiple hops are strictly forbidden.
3. Lawful Conduct: Users must comply with all applicable local and international laws and regulations when using the service and shall not engage in any illegal, abusive, or deceptive activities.

3.3 Data and Privacy Protection

1. Transparency & Consent: Users may use short links to carry tracking parameters (e.g., UTM, referral identifiers) but must clearly inform end-users of the data usage and obtain necessary consent in accordance with privacy laws.
2. No Deceptive Practices: Short links shall not be used to conceal misleading or covert data collection practices. Any attempt to hide or disguise the true purpose or destination of the link is not supported and constitutes grounds for termination.

IV. User Responsibilities and Obligations

• Truthfulness of Information: When subscribing to the service, users must ensure that all information provided is complete, true, accurate, and error-free.
• Account Security: Users are solely responsible for the security of their accounts, passwords, and API credentials, and may not transfer, resell, or share their accounts with unauthorized third parties.
• Lawful Use: Users warrant that all activities conducted through the service comply with applicable national and international laws and regulations, are lawful and truthful, and do not infringe upon any third party’s legitimate rights, trademarks, or intellectual property.
• Consequences of Violation: If a user breaches these terms while using the service, the Platform reserves the right to immediately block the account, disable all associated shortened links without refunding any paid fees, and report the matter to relevant regulatory or law enforcement authorities.

V. Platform Rights and Disclaimers

5.1 Platform Rights

• Right of Review: The Platform has the right to review all shortlink content and landing destinations for security purposes, and to reject, flag, or delete any short links suspected of violation.
• Right to Modify Services: The Platform reserves the right to modify or update this Subscription Plan at any time. Changes will become effective immediately upon being posted on the Platform.
• Right to Terminate Services: For users who violate this agreement or engage in abusive practices, the Platform may immediately terminate service without refunding any fees already paid.

5.2 Disclaimers

• User Assumes Risk: Users fully understand and agree that they use the Platform’s online URL shortening and tracking services at their own risk.
• Third-Party Service Failures: The Platform is not liable for temporary service interruptions caused by failures of network service providers, upstream internet backbone disruptions, or client hosting outages, but shall make reasonable commercial efforts to resolve technical issues.
• Force Majeure: The Platform is not liable for service interruptions resulting from force majeure events, including but not limited to government or judicial orders, natural disasters, cyber conflicts, wars, or changes in statutory regulations.
• Disclaimer of Consequential Damages: Except as otherwise expressly agreed, any compensation shall be strictly limited to direct economic losses and shall not include indirect, incidental, or consequential losses (including but not limited to loss of revenue, anticipated profits, data loss, operating rights, business opportunities) nor punitive damages.
• Link Content Disclaimer: Users are solely and exclusively responsible for the landing page content of their shortened links and all legal consequences arising therefrom. The Platform assumes no responsibility for any third-party content, services, or goods to which user links point.
• Cap on Liability: The Platform’s total cumulative liability for any single incident or claim shall not exceed the total subscription fees actually paid by that user to the Platform during the twelve (12) months preceding the incident.

VI. Security and Risk Control Measures

• Redirection Chain Tracking: The Platform provides a visual redirection chain tracking tool to facilitate transparent review of the destination page and intermediate hops by both users and Platform compliance officers.
• Rate Limiting and Abnormal Traffic Protection: The Platform integrates high-performance Web Application Firewall (WAF) and automated risk control algorithms to enforce rate limiting, detect abnormal bot surges, and mitigate DDoS disruptions.
• Batch Invalidation and Recovery Strategy: The Platform maintains real-time administrative tooling to immediately disable, freeze, or reroute abusive short links across cluster nodes upon detection.
• Log Preservation: The Platform supports exporting shortlink lists and access logs to preserve evidentiary data for appeals, audits, and legal inquiries.

VII. Dispute Resolution

The formation, execution, interpretation of this agreement, as well as the resolution of any disputes arising hereunder, shall fall within the scope of the Platform’s legal department functions.

Any dispute arising out of or in connection with this agreement shall first be settled through friendly negotiation between the parties. If negotiation fails, either party may bring a lawsuit before the competent court in the jurisdiction where the Platform operator is domiciled.

VIII. Effectiveness of the Agreement

This Subscription Plan and Agreement shall take effect immediately from the date on which the user confirms acceptance on the subscription page and completes payment through EarnWay Wallet (EW) or designated billing gateway.
